Terms and Conditions for Advertising with Emerge Initiatives

These Terms and Conditions govern the advertising services provided by Emerge Initiatives (“Company”) to advertisers (“Advertiser”) through our magazine, events, or radio/podcast platforms (collectively referred to as “Advertising Services”). By submitting an advertising request, the Advertiser agrees to these Terms and Conditions.

1. Ad Placement

– Advertisements will be placed in the agreed-upon format and location as specified in the advertising agreement.
– The Company reserves the right to determine the final placement of all advertisements.

2. Ad Content

– Advertiser is responsible for providing all ad content, including text, images, and any other materials necessary for the advertisement.
– All content must comply with applicable laws and regulations, and must not be misleading, defamatory, obscene, or infringe upon any third-party rights.
– The Company reserves the right to reject or modify any advertisement that does not meet these standards or that conflicts with our policies.

3. Payment Terms

– Advertiser is responsible for providing all ad content, including text, images, and any other materials necessary for the advertisement.
– All content must comply with applicable laws and regulations, and must not be misleading, defamatory, obscene, or infringe upon any third-party rights.
– The Company reserves the right to reject or modify any advertisement that does not meet these standards or that conflicts with our policies.

4. Cancellation and Refund Policy

– Advertisers may cancel their advertising agreement up to 20 (twenty) days before the scheduled advertising date for a 50% refund.
– Cancellations made less than 20 (twenty) days prior to the advertising date may incur cancellation fees as specified in the advertising agreement.

5. Liability

– The Company is not liable for any indirect, incidental, or consequential damages arising from the Advertiser’s use of the Advertising Services.
– In no event shall the Company’s liability exceed the total amount paid by the Advertiser for the advertising services provided.

6. Intellectual Property

– The Advertiser grants the Company a non-exclusive, royalty-free license to use, reproduce, and display the advertisement in connection with the Advertising Services.
– All intellectual property rights in the advertisement remain with the Advertiser.

7. Confidentiality

– Both parties agree to keep confidential any proprietary information disclosed during the course of the advertising relationship, unless required by law.

8. Governing Law

– These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Virginia.

9. Amendments

– The Company reserves the right to amend these Terms and Conditions at any time. Any changes will be communicated to the Advertiser in writing.

10. Acceptance

– By submitting an advertising request, the Advertiser acknowledges that they have read, understood, and agreed to these Terms and Conditions.
